Terms of Service

These Terms of Service (“Terms”) govern your use of the services and website of The Waterproofing Pros LLC, a New Jersey limited liability company (“The Waterproofing Pros,” “we,” “us”), including our customer portal at portal.thewaterproofingpros.com and any text-message program we operate (collectively, the “Service”). By accessing or using the Service, or by providing your phone number and consenting to receive text messages, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Waterproofing Pros provides residential and commercial waterproofing, masonry, and foundation services, along with the related contracts, estimates, invoices, scheduling, and customer communications delivered through the Service.

By providing your phone number and consenting, you agree to receive transactional and customer service text messages from The Waterproofing Pros, including appointment reminders, contract and estimate notifications, payment confirmations, and job updates. Message frequency varies based on your account activity and scheduled services. Message and data rates may apply. To opt out at any time, reply STOP to any message. For help, reply HELP or contact us at (732) 500-2616 or office@thewaterproofingpros.com. We will never sell or share your phone number or SMS opt-in data with third parties for marketing purposes. Reply STOP to unsubscribe at any time. After you send STOP, we will send a single confirmation and no further messages unless you re-subscribe by replying START. Reply HELP for help, or contact us at (732) 500-2616 / office@thewaterproofingpros.com. Carriers are not liable for delayed or undelivered messages.

If you are issued a portal account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@thewaterproofingpros.com if you suspect unauthorized access. Do not share your credentials with anyone.

You agree not to:

• Reverse engineer, scrape, or circumvent technical protections of the Service;
• Use the Service in a way that violates applicable law or our policies;
• Interfere with other users’ access or the integrity of the Service;
• Upload content you do not have the right to upload.

Your data is handled according to our Privacy Policy. The Service integrates with third-party providers (including QuickBooks Online, QuickBooks Payments, Resend, and Supabase) to deliver core functionality. By using the Service you consent to these integrations.

Payment terms for services are governed by your signed contract(s) and the invoices we issue. Deposits, progress payments, and final balances are due as stated on the applicable contract or invoice. Online payments made through the Service are processed by Intuit Inc. (QuickBooks Payments); card numbers, bank details, and other payment instrument data are handled by Intuit directly and are not stored on our servers. You are responsible for the accuracy of payment information you submit and for all authorized charges.

The Service relies on the following third-party providers:

• QuickBooks Online (Intuit Inc.) — accounting integration
• QuickBooks Payments (Intuit Inc.) — payment processing
• Resend — transactional email delivery
• Supabase — database and file storage
• DocuSeal — electronic signature

Your use of those providers through the Service is also subject to their respective terms and privacy policies.

The Service’s software, design, and content (excluding data you upload) are owned by The Waterproofing Pros LLC and protected by intellectual property laws. You retain ownership of data you upload, and you grant us a limited license to host and process it solely to operate the Service for you.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

To the maximum extent permitted by law, The Waterproofing Pros LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service.

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion. You may stop using the Service at any time.

We may update these terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after a change constitutes acceptance of the new terms.

These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in New Jersey.
